Terms and conditions for the purchase and sale of products (distance agreement) at the online store of SIA “Latvijas Pārtikas ražotājs”
- General terms and conditions
- These terms and conditions for the purchase and sale of products (hereinafter – the “Terms and Conditions”) provide for the general terms and conditions of the online store www.latpartika.lv of SIA “Latvijas Pārtikas ražotājs” (hereinafter – the “Online Store”), which apply to the Buyers who order the products at the Online Store.
- SIA “Latvijas Pārtikas ražotājs”, registration No. 40103325950, legal address: Sturainu (Stūraiņu) Street 6, Rumbula, Stopiņu municipality, LV-2119, Latvia (hereinafter – the “Seller”) sells the products, organizes the sale of the products, and provides related services to the Buyer at the Online Store.
- For the purposes of these Terms and Conditions, the Buyers are capable natural or legal persons which shop at the Online Store.
- By shopping at the Online Store, the Buyer confirms that he or she agrees with these Terms and Conditions. Together with the purchase order placed by the Buyer, these Terms and Conditions shall become an agreement entered into between the Buyer and the Seller, and shall be a legal document binding on both parties. The agreement shall be deemed to be entered into if the Buyer prepares and submits a product purchase order to the Online Store, makes a payment in accordance with the procedure and within the time limit specified in the Terms and Conditions, and the Seller sends a confirmation on the acceptance of the Buyer’s order to the e-mail address specified by the Buyer. The Agreement shall remain in force until the obligations of the parties resulting from this Agreement are fulfilled.
- The Seller shall reserve the right to unilaterally change, amend or supplement the Terms and Conditions. The current version of the Terms and Conditions shall be available on the website of the Online Store. The Buyer may read the Terms and Conditions before each purchase.
- The Seller shall not assume any risk or responsibility if the Buyer has not read the Terms and Conditions or has read them in part, even though he or she had such a possibility.
- The Seller shall have the right to unilaterally restrict the use of the Buyer’s Online Store services without notice if the Buyer uses the Online Store violating these Terms and Conditions or attempts to harm in any way the operation and (or) security of the Online Store.
- Processing of personal data
- The Buyer who wants to use the Online Store and to purchase the products offered thereof shall submit, before placing the order, certain personal data: name, surname, telephone number, e-mail address and product delivery address.
- The Buyer shall be responsible for providing accurate, correct and complete data. In no event the Seller shall be responsible for any losses incurred by the Buyer and (or) third parties due to incorrect and (or) incomplete personal data provided by the Buyer.
- The Buyer’s personal data shall be processed in accordance with the Privacy Policy. If the Buyer uses the services of the Online Store, it shall be deemed that he or she has agreed with the processing of personal data and confirms that all information and personal data provided are correct and true and agrees that notifications on the purchase, payment and delivery of the products will be sent to the specified e-mail address.
- The Company guarantees that the Buyer’s data shall be used only for the purpose of purchasing the products and direct marketing (if the Buyer has agreed to receive commercial notifications by e-mail).
- The Company shall undertake to ensure the confidentiality of personal data provided by the Buyer and not to disclose the Buyer’s personal data to third parties, except for the Company’s partners who deliver the products to the Buyer or provide other services related to the fulfilment of the order, as well as to the public authorities in the cases specified in the regulatory enactments.
- At the time of delivery of the products, the Buyer may be required to present an identity document to establish the identity of the person.
- Product prices, payment procedure and terms
- The product prices at the Online Store and in the purchase order shall be indicated in EUR including the VAT valid in the Republic of Latvia. The products shall be sold to the Buyer at the prices that are valid at the Online Store at the time of placing the order.
- It is possible to pay for the products using Internet banking or payment card services.
- The Buyer, upon choosing to pay for the products at the time of placing the order in accordance with Clause 3.2 of the Terms and Conditions, shall undertake to pay for the products ordered immediately. The Seller shall start the execution of the order only at the moment when the appropriate payment is received from the payment system operator of its choice, and the product delivery term shall also be calculated from that moment.
- Upon placing the order, the Buyer shall confirm the consent to receive the invoice electronically.
- The Seller shall issue and send the invoice to the Buyer’s e-mail address specified at the time of placing the order no later than within 3 (three) business days after delivery of the products.
- The invoice shall be prepared electronically and shall be valid without a signature.
- Warranty
- To avoid misunderstandings, when receiving the product, please make sure whether the product corresponds to the order.
- The main characteristics of the products, as well as the expiry date and the manufacturer shall be indicated on the packaging.
- A warranty is a free of charge promise by the manufacturer or Seller to refund to the Buyer the amount paid for the product or thing, to exchange the product for a corresponding product, to eliminate the non-conformity of the product or thing or to perform other actions if the product or thing does not meet the description provided in the warranty.
- The warranty rights shall be exercised in compliance with the regulatory enactments effective in the Republic of Latvia, as well as the type, specific properties of the product and the specified storage conditions (temperature, etc. restrictions);
- It shall be possible to exercise the warranty rights if the Buyer has kept a document confirming the purchase, which has to be submitted to the Seller together with the product purchased.
- The Buyer shall be entitled to submit a claim during the entire warranty period in accordance with the conditions specified in the warranty document (product packaging). The claim submitted by the Buyer shall be examined in accordance with the conditions specified in the warranty document.
- Right of withdrawal
- The products manufactured by the Seller shall have a limited period of validity (maximum 5 days), therefore, in accordance with Clause 22.4 of the Cabinet Regulation No. 255 “Regulations Regarding Distance Contracts” of 20 May 2014, the Buyer may not exercise the right of withdrawal when purchasing any of the Seller’s products.
