Terms and conditions of the contract for the sale of goods (distance contract) in the online shop of SIA “Latvijas Pārtikas ražotājs”
1.General conditions
These Terms and Conditions of Sale and Purchase of Goods (hereinafter - the „Terms and Conditions”) set out the general terms and conditions of the online store of SIA “Latvijas Pārtikas ražotājs” www.latpartika.lv (hereinafter - the „Online Store”) that apply to Customers who order goods from the Online Store.
The goods are sold in the online shop, the sale of goods is organised, executed and related services are provided to the Buyer by SIA „Latvijas Pārtikas ražotājs”, registration no. 40103325950, legal address: 6 Stūraiņu Street, Rumbula, Stopiņu District, LV-2119, Latvia (hereinafter - the „Seller”).
For the purposes of these Terms and Conditions, Customers are persons who are natural or legal persons with legal capacity and who shop in the Online Shop.
By making a purchase in the Online Shop, the Customer confirms that he/she agrees to these Terms. Together with the order placed by the Buyer, these Terms and Conditions become a contract between the Buyer and the Seller and constitute a legally binding document for both parties. The Contract shall be deemed to be concluded if the Buyer prepares and submits an order for goods to the Online Shop, makes payment in accordance with the procedure and within the terms set out in the Terms and Conditions and the Seller sends confirmation that the Buyer's order has been accepted to the e-mail address provided by the Buyer. The Contract shall remain in force until the obligations of the parties under this Contract have been fulfilled.
The Seller reserves the right to unilaterally amend, correct or supplement the Terms. The current version of the Terms and Conditions is available on the Online Shop's website. The Buyer shall have the opportunity to read the Terms and Conditions before each purchase.
The Seller shall not accept any risk or liability if the Buyer has not read the Conditions in part or in full, even if given the opportunity to do so.
The Seller shall have the right to unilaterally restrict the use of the Buyer's Online Shop services without notice if the Buyer uses the Online Shop in violation of these Terms or attempts to harm the operation and/or security of the Online Shop in any way.
2.Processing of personal data
A customer who wishes to use the Online Shop and purchase the goods offered therein must provide certain personal data before making a purchase: name, surname, telephone number, e-mail address and delivery address.
The Buyer is responsible for ensuring that the data provided is accurate, correct and complete. In no event shall the Seller be liable for any damages suffered by the Buyer and/or third parties as a result of the Buyer providing incorrect and/or incomplete personal data.
The Buyer's personal data is processed in accordance with the Privacy Policy. If the Customer uses the services of the Online Shop, the Customer shall be deemed to have consented to the processing of personal data and shall confirm that all the information and personal data provided is correct and true and shall consent to the sending of notifications regarding the purchase, payment and delivery of goods to the e-mail address provided.
The Company guarantees that the Customer's data will only be used for the purchase of goods and for direct marketing purposes (if the Customer has consented to receive commercial communications by e-mail).
The Company undertakes to ensure the confidentiality of personal data provided by the Customer and not to disclose the Customer's personal data to third parties, except for the Company's partners who provide delivery of goods to the Customer or provide other services related to the execution of the order, as well as to state institutions in the cases provided by the regulatory enactments.
The Buyer may be asked to produce proof of identity at the time of delivery to ascertain the identity of the person.
3.Prices, payment terms and terms of payment
The prices of the goods in the online shop and in the order are indicated in Euro with the VAT rate in force in the Republic of Latvia. The Goods shall be sold to the Customer at the prices prevailing in the Online Shop at the time of placing the order.
You can pay for goods using online banking or payment cards.
If the Buyer chooses to pay for the Goods at the time of ordering in accordance with Clause 3.2 of the Conditions, the Buyer undertakes to pay for the Goods ordered immediately. Only when the Seller receives the Buyer's corresponding payment for the Goods from the payment system operator of its choice shall the Seller commence the execution of the order and the delivery period shall be calculated from that moment.
By placing an order, the Buyer confirms his/her consent to receive the invoice electronically.
The Seller shall issue and send to the Buyer a bill of lading-invoice to the Buyer's e-mail address specified at the time of purchase no later than within 3 (three) working days after delivery of the Goods.
The invoice is electronic and valid without signature.
4.Warranty
To avoid any misunderstandings, please check upon receipt that the goods delivered are as ordered.
The main characteristics of the goods, as well as the expiry date and the manufacturer, are indicated on the packaging.
Warranty means a promise by the manufacturer or seller, free of charge, to refund to the Buyer the amount paid for the goods or thing, to exchange the goods or thing for a conforming one, to remedy the non-conformity of the goods or thing free of charge or to take any other action if the goods or thing do not conform to the characteristics set out in the warranty.
The warranty right shall be exercised in compliance with the laws and regulations in force in the Republic of Latvia, as well as with the type of goods sold, specific characteristics and storage conditions (temperature and other restrictions);
The exercise of the warranty right is possible if the Buyer has retained the proof of purchase, which must be submitted to the Seller together with the purchased goods.
The Buyer is entitled to make a claim throughout the warranty period under the conditions stated in the warranty document (the product packaging). The Buyer's claim shall be dealt with in accordance with the conditions set out in the warranty document.
5.Right of withdrawal
The Seller's goods have a limited shelf life (maximum 5 days), therefore, in accordance with Clause 22.4 of the Cabinet of Ministers Regulation No.255 of 20 May 2014 “Regulations on Distance Contract”, the Buyer cannot exercise the right of withdrawal when purchasing any of the Seller's goods.
